Welcome to BottomBinky. These Terms of Service ("Terms") govern your access to and use of bottombinky.com (the "Site"), our store, and any products or services we offer. By browsing the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BottomBinky. Please read both carefully.

1. Age Requirement — 18+ Only

This Site contains adult content and sells products intended exclusively for adults. You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to access the store, create an account, or place an order.

  • By using this Site, you represent and warrant that you meet the applicable age requirement.

  • We reserve the right to correct pricing errors. If an item was ordered at an incorrect price, we will contact you before processing or cancel the order with a full refund.
  • Promotional codes and discounts are subject to the terms announced with each offer and may expire or be withdrawn at any time.
  • Promotional codes cannot be combined unless explicitly stated, and do not apply to already-discounted items unless specified.
  • Free shipping thresholds (if offered) apply to the subtotal after discounts and before tax.

6. Orders and Payment

  • All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, inaccurate pricing, or product unavailability.
  • Payments are processed securely by our authorized payment processor, a PCI-DSS compliant provider. Your card data is transmitted directly to the processor via their encrypted checkout and is never stored on our servers.
  • Your billing statement will show a discreet descriptor — "BB Online" — not "BottomBinky" or any adult-identifying name.
  • By placing an order, you agree to the payment processor's terms of service and authorize us to charge your payment method for the total amount of your order, including shipping and applicable taxes.
  • If a payment is declined, we may cancel your order or contact you for an alternative payment method.

7. Shipping and Fulfillment

7.1 Discreet Shipping

  • All orders ship in plain, unmarked packaging with no exterior branding, logos, or adult-identifying content.
  • The return address shows "BB Online" — not BottomBinky.
  • Customs declarations for international shipments use generic product descriptions (e.g., "novelty item," "personal care product").

7.2 Fulfillment Partner

Orders are fulfilled by Nalpac, our third-party dropshipping and fulfillment partner based in Ferndale, Michigan. Nalpac receives your name, shipping address, and product SKUs only — not your payment information or purchase history. Nalpac packs and ships your order directly to you.

7.3 Delivery

  • Delivery timeframes are estimates only. We are not responsible for delays caused by carriers, customs, weather, or other factors outside our control.
  • Title and risk of loss pass to you upon delivery to the carrier.
  • We currently ship to addresses within the United States. International shipping may be available on a case-by-case basis.
  • We are not responsible for import duties, taxes, customs delays, or confiscated shipments for international orders.
  • Lost or delayed packages: contact us at support@bottombinky.com and we will work with the carrier to resolve the issue.

8. Returns and Refunds

8.1 General Return Policy

  • For hygiene and safety reasons, we cannot accept returns on opened or used products. This policy protects all customers and is non-negotiable.
  • Unopened items in original, sealed packaging may be returned within 30 days of delivery for a full refund (excluding shipping costs).
  • To initiate a return, contact support@bottombinky.com with your order number and reason for return.
  • Approved returns must be shipped prepaid. We are not responsible for return shipments lost or damaged in transit — use a tracked shipping service.
  • Refunds are issued to the original payment method within 5–10 business days of receiving the returned item.

8.2 Damaged or Defective Items

  • Contact us within 7 days of delivery with photos of the damage or defect.
  • We will arrange a replacement or full refund, including return shipping if applicable.
  • Do not return damaged items without contacting us first — we may instruct you to dispose of them for hygiene reasons.

8.3 Non-Returnable Items

  • Opened or used products (hygiene items)
  • Lingerie and wearable items with broken seal/hygiene strip
  • Lubricants, oils, and consumables that have been opened
  • Items damaged by misuse, improper care, or failure to follow manufacturer instructions

9. Accounts

  • You may create an account to track orders, save preferences, and speed up checkout. Account features are optional — you may also check out as a guest.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You agree to provide accurate, current, and complete information during registration and to update it as needed.
  • We reserve the right to suspend or terminate accounts that violate these Terms or that we believe are being used fraudulently.
  • You must be 18+ to create an account. Accounts created by minors will be deleted immediately.

10. Prohibited Uses

You agree not to use this Site to:

  • Place orders if you are under 18 or the applicable age of majority in your jurisdiction

19. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law provisions.

  • Any dispute arising from these Terms or your use of the Site shall first be attempted to be resolved through good-faith negotiation.
  • If unresolved within 30 days, disputes shall be submitted to binding arbitration in Louisville, Kentucky, under the rules of the American Arbitration Association.
  • The arbitrator's award shall be final and binding, and judgment may be entered in any court of competent jurisdiction.
  • You waive any right to a jury trial or to participate in a class action or class arbitration.
  • Notwithstanding the above, we may seek injunctive relief in any court of competent jurisdiction to protect our intellectual property or other rights.

If any provision of these Terms is found to be unenforceable or invalid by a court or arbitrator, that provision shall be modified to the minimum extent necessary to make it enforceable, and all remaining provisions shall remain in full force and effect.

21. Assignment

You may not assign, transfer, or sublicense these Terms or your account to any third party without our prior written consent. We may assign these Terms or our rights and obligations hereunder to a successor entity in connection with a merger, acquisition, or sale of all or substantially all of our assets. Any attempted assignment in violation of this section is void.
